Federal Probe Investigates Denver’s All-Gender Bathroom Decisions

United States: The U.S. Department of Education started a formal investigation of Denver Public Schools’ alleged discrimination when the school converted a women’s restroom into a space open to all genders. This investigation exposes the national discourse about gender policies as well as Title IX regulatory compliance standards, as reported by Reuters.
Restroom Policy Sparks Federal Scrutiny
Officials stated that Denver’s East High School now has a designated restroom for male students but lacks an equivalent facility for female students on its second floor. Reports also suggest that similar all-gender restrooms exist in two other Denver schools, prompting further review.
Denver Public Schools Defends Decision
School district spokesperson Scott Pribble emphasized that the restroom conversion was a student-led initiative aimed at fostering inclusivity. “This bathroom was added as the result of a student-led process that reflects our commitment to inclusivity and student voice, leadership, and empowerment,” Pribble stated. The all-gender restroom features tall partitions to ensure privacy for all students.

Title IX Concerns Raised by Federal Officials
Craig Trainor, a civil rights official at the Education Department, reinforced the administration’s stance on gender policies. “It is a new day in America, and under President Trump, we will not tolerate discrimination of any kind,” Trainor declared.
Under Title IX law federal funding sets the groundwork for this investigation because it stops educational institutions from practicing sexual discrimination. Through a written letter Trainor expressed his belief to Denver Public Schools Superintendent Alex Marrero that the restroom policy potentially violated rights protected under Title IX.
Nationwide Policy Shift and Legal Challenges
President Trump initiated his executive order on his first day in power to establish male and female gender categories for every federal policy. Legal challenges have begun over the transgender military service restriction as lawyers launched a law suit on Tuesday to oppose the new military ban, as reported by Reuters.
In a related ruling, a Kentucky court upheld a decision allowing schools to maintain sex-specific facilities under Title IX, reinforcing the administration’s position.
Potential Consequences for Denver Schools
If found in violation of Title IX, Denver Public Schools may face a settlement agreement rather than severe penalties. However, continued noncompliance could put the district at risk of losing federal funding.
